MUSIC EQUIPMENT RENTAL TERMS

Article 1 – OBJECT AND ACCEPTANCE

 

1.1. The present Music Equipment Rental Terms (“MERT”) shall apply, without limitation or qualification, to any order for the rental of music equipment by the Client to VintageRig, in addition to VintageRig’s General Terms of Sale (“GTS”), and to the exclusion of all other terms and conditions, unless otherwise agreed in writing by the Client and VintageRig.

 

1.2. The fact that the Client places an order for the rental of music equipment with VintageRig implies his/her full acceptance of the present MERT and the GTS available on the website www.vintagerig.com.

 

1.3. The present MERT are accessible at any time on the website www.vintagerig.com and are provided as an annex to the quotes and invoices issued by VintageRig. Where applicable, they take precedence over any previous version and over any general conditions of purchase or other conditions of the Client.

 

1.4. The present MERT are dated 1st January 2023 and are applicable from that date. VintageRig reserves the right to modify the present MERT at any time.

Article 2 – PRICE

 

2.1. Each good that VintageRig offers for rent has an index (displayed on the website www.vintagerig.com) that allows the calculation of the rental price according to the duration requested by the Client. This price is determined by calculating the product of this index and the relevant rate among the five following rates (PRICE = INDEX x RATE): 

 

- Rate for a 24-hour rental: 10 €
- Rate for a 3-day rental: 15 €
- Rate for a 7-day rental: 21 €
- Rate for a 14-day rental: 28 €
- Rate for a 30-day rental: 45 €

2.2. If the Client rents several goods at the same time, VintageRig commits to offering a minimum discount of 10% on the total amount invoiced.

Article 3 – COLLECTION OF THE RENTED GOODS

 

3.1. The Client commits to collecting in person the rented good(s) on the date, at the time and at the place agreed with VintageRig. 

 

3.2. The Client shall be obliged to present an identity document when collecting the rented good(s) before taking possession of it/them. If the Client engages a third party to collect the rented good(s), this third party must be in possession of the Client’s identity document. 

 

3.3. The Client must always inspect the goods that VintageRig has rented out to him/her at the time of receipt to be able to report any possible anomalies to VintageRig in good time. 

 

3.4. If the Client who placed the order does not collect the rented good(s) on the agreed date, time and place, the full price for the agreed rental period will still be charged.

Article 4 – USE AND MAINTENANCE OF THE RENTED GOODS

 

4.1. The Client commits to using and maintaining the good(s) rented from VintageRig exclusively in accordance with its normal use and with the utmost care so as to maintain its perfect integrity and therefore its value.

4.2. In the event of a problem such as a breakdown, failure, damage or loss, the Client shall immediately inform VintageRig by telephone and/or email. Any notification of a substantial problem that calls into question the estimated value of the rented good(s) must imperatively be accompanied by a confirmation by email within 48 hours including a detailed description of the problem encountered.

4.3. The Client is expressly forbidden to carry out or have carried out any modifications or repairs on the rented good(s). Failing that, VintageRig can hold the Client responsible for additional costs that are proportionate to the damage caused by the Client.

Article 5 – RETURN OF THE RENTED GOODS

 

5.1. The Client commits to returning in person the rented good(s) to VintageRig in the same condition in which he/she received them from VintageRig, on the date, at the time and place agreed with VintageRig, and in any case before the expiry of the agreed rental period. 

 

5.2. In the event of late return of the good(s) by the Client, VintageRig is entitled to charge the Client the price of one additional day’s rental for each day of delay. The day of delay starts at the beginning of each new 24-hour period following the agreed rental period. 

 

5.3. Unless otherwise agreed in writing between the Client and VintageRig, the early return of the good(s) will not result in a reduction of the rental price.

 

5.4. It is the responsibility of the Client to check the rented equipment when returning it after the rental period and not to hand over any accessories belonging to him/her. VintageRig is not responsible for the loss or damage of the equipment belonging to the Client. 

 

5.5. VintageRig will inspect the rented good(s) at the time of return and will inform the Client immediately and at the latest within five working days of the return of the rented good(s) of any damage, loss, or missing item(s) to the rented good(s).

Article 6 – LIABILITY

 

6.1. Except in the case of intentional or gross negligence and unless otherwise provided for by law, VintageRig is not liable for any direct, indirect, or consequential damage resulting from the use of the rented good(s) by the Client. 

 

6.2. The responsibility for the possession of the rented good(s) and the risks inherent in its/their use rests entirely with the Client during the entire rental period. 

 

6.3. In particular, the Client is responsible for the loss or theft of the rented good(s) as well as for any damage caused to the good(s) during the rental period agreed with VintageRig. 

 

6.4. If the rented good(s) is/are damaged or lost, the Client will compensate VintageRig for the damage caused by the loss of the good(s), based on the estimated value of the good(s) as determined in the music rental agreement between VintageRig and the Client.
